1 Provider and scope

1.1 The provider is SKY SOCIETY – FZCO, IFZA Business Park, DDP, Dubai Silicon Oasis, Dubai, United Arab Emirates, licence number 49170, referred to below as Sky Society. Contact for bookings, changes, cancellations and complaints: hello@skysocietyjet.com, telephone +971 50 497 0429.

1.2 These terms apply to bookings made by adult private individuals through skysocietyjet.com. They cover the sale of individual seats on shared flights (jet sharing) and the sale of full charter flights.

1.3 Terms of the customer that differ from these do not become part of the contract.

2 Subject of the service

2.1 Sky Society sells carriage services in its own name and for its own account. The customer's sole contracting party is Sky Society; no direct contract arises between the customer and the operating air carrier.

2.2 Sky Society operates no aircraft of its own and holds no Air Operator Certificate. Flights are performed by licensed air carriers engaged by Sky Society, referred to below as the operator.

2.3 Sky Society does not arrange accommodation, transfers or other travel services and does not offer package travel. On request, Sky Society will name contacts for hotels, transfer providers or an agency for pet travel; the customer concludes those contracts directly with the providers concerned.

3 Contract documents and communication

3.1 The specific scope of the service follows from the offer and the booking confirmation. Individually agreed terms take precedence over these terms.

3.2 The customer actively accepts these terms during the booking process. The accepted version is sent with the booking confirmation as a PDF and carries a version number and date. Later changes to these terms do not apply to bookings already confirmed.

3.3 Binding notices are given through the booking portal and by e-mail. Changes and cancellations may be declared through the portal or by e-mail to hello@skysocietyjet.com. For the purpose of meeting deadlines, the documented receipt by Sky Society is decisive. For notices from Sky Society to the customer, receipt by the customer is decisive.

4 Booking and operation confirmation for jet sharing

4.1 Bookings are made through the website. Before payment, seat availability and the general possibility of carrying a registered animal are checked.

4.2 A binding booking requires payment to be received in full. Enquiries and availability information do not create a seat booking. If the seat is no longer available when payment is received, the customer receives a full refund or may choose an alternative offered.

4.3 A minimum number of seats sold is set for each shared flight. If it is not reached, Sky Society may cancel the flight under section 4.4. Seats are sold before the aircraft is chartered on a binding basis; the binding customer booking is therefore distinct from the operation confirmation. The required minimum number is stated before booking on the booking page and repeated in the booking confirmation.

4.4 If the minimum number is not reached, Sky Society may cancel the flight. Notice of cancellation must reach the customer within the cancellation notice period stated for the flight concerned, and in no event later than 14 days before the scheduled departure time. The period applying to the flight is stated before booking on the booking page and repeated in the booking confirmation. Once that period has expired, the flight can no longer be cancelled for failure to reach the minimum number. If Sky Society does not cancel, the flight is operated as booked. Once operation has been confirmed, a later drop in occupancy is no longer treated as a minimum-occupancy cancellation.

4.5 Where a flight is cancelled under section 4.4, the fare paid is refunded in full. The customer may instead choose voluntarily to rebook onto another flight. A voucher or a rebooking replaces a refund claim only with the customer's consent.

4.6 Bookings for flights already confirmed are possible subject to availability up to one day before departure. The documents and permits required for an accompanying animal must be in place.

5 Scope of service, price and flight times

5.1 The total price stated is a fixed price. It covers all operational costs and charges, in particular fuel, positioning, crew, landing, take-off, handling, security and passenger charges. It does not cover the cost of de-icing under section 5.8, which is shown separately before booking. Apart from that, a subsequent increase is excluded, in particular on account of increased fuel costs. Only services separately ordered by the customer after booking are charged in addition.

5.2 The fare includes the passenger seat, the confirmed carriage of one animal in the cabin, catering and drinks, airport handling, and one checked bag of up to 25 kg and one item of hand baggage of up to 8 kg. Where the aircraft used imposes different limits, these are communicated before booking.

5.3 An internet connection on board is not part of the service. Whether one is available depends on the aircraft used. Where a connection is technically available, it may be used only with Sky Society's prior release; using it may trigger high usage-based charges from the operator. If a passenger activates or uses the connection without that release, the customer bears the costs charged for it by the operator in the amount evidenced.

5.4 A second animal, additional baggage and special catering require a separate agreement and prior confirmation of the price.

5.5 The flight date and the departure and destination airports are agreed on a binding basis. The time stated at booking is provisional; the intended time window covers the calendar day booked. The exact details are communicated no later than 24 hours before departure. The customer's statutory rights in the event of delay remain unaffected.

5.6 Flights are offered as non-stop flights as a rule. Any stopovers already planned are stated before booking.

5.7 The customer informs Sky Society of food intolerances and allergies to be taken into account for the on-board catering no later than seven days before the scheduled departure time. Where the booking is made later than that, the information is to be given without delay when booking. Without timely notice the on-board catering can no longer be adapted; the passenger concerned may then decline the on-board catering or bring their own.

5.8 The cost of de-icing the aircraft is not included in the fare. It arises only where de-icing is actually required on the day of the flight. Where the operator charges Sky Society such costs, they are shared equally among the passengers carried on that flight and invoiced after the flight. The share per passenger is no more than EUR 250. Sky Society evidences the costs by the operator's invoice; the customer may ask to see it. The possibility of this charge and its upper limit are stated before booking on the booking page.

6 Changes and substitute aircraft

6.1 The aircraft type stated is the type planned. Sky Society may use another suitable type provided that the seats booked, the confirmed carriage of the animal in the cabin and the agreed baggage allowance remain assured.

6.2 Material changes, in particular a different flight day, a material change of airport or the loss of the confirmed carriage of the animal in the cabin, are communicated to the customer. The customer may agree to them or cancel the booking concerned without a cancellation charge and reclaim the fare.

6.3 Unplanned intermediate landings for reasons of safety, weather, medical need or technical necessity remain possible. The decision is taken by the operator or the captain. Statutory claims remain unaffected.

7 Cancellation, delay and air passenger rights

7.1 In the event of a technical defect or failure on the part of the operator, Sky Society will endeavour to provide a suitable replacement flight at no additional cost that preserves the agreed services. Where such a replacement is not possible, the flight service not provided is refunded. Any statutory right to choose between a refund and alternative carriage is not restricted by this.

7.2 In the event of airspace closures, official flight bans, extreme weather or comparable obstacles, the customer may choose between a postponement offered and a refund of the flight service not provided. Payments are not withheld on grounds of force majeure.

7.3 Claims under Regulation (EC) No 261/2004 lie against the operating air carrier. Sky Society forwards the customer's reports to the operator without delay and provides the customer with the operator's contact details. Further statutory claims of the customer against Sky Society remain unaffected.

7.4 Outbound and return flights are booked with their own price and their own operation confirmation. Where they were booked together as one journey and one of the flights is cancelled by the provider, the customer may also cancel the corresponding flight not yet taken free of charge.

8 Cancellation by the customer

8.1 The customer may cancel the entire booking or individual passengers by the means set out in section 3.3. In the case of a partial cancellation, only the fare attributed to the passenger concerned forms the basis of calculation.

8.2 If the customer cancels before the operation confirmation, the following is retained from the total price of the booking:

8.3 If the customer cancels after the operation confirmation or does not appear for departure, the fare is not refunded. With the operation confirmation, Sky Society commits to all customers on that flight that it will be operated; a cancellation for insufficient occupancy is excluded from that point under section 4.4. The aircraft is chartered for the whole flight at a fixed price that does not depend on the number of passengers actually travelling; the share of that price attributable to the individual seat arises even if the seat remains empty. Section 8.5 remains unaffected.

8.4 Non-refundable costs that Sky Society has already incurred specifically for the customer, a passenger or an animal may additionally be deducted from the refund amount, so far as the applicable law permits.

8.5 In every case the customer remains free to show that no loss has arisen or that it is substantially lower than the amount retained; the amount retained is then reduced accordingly. Expenses saved, refunds received and any other use made of the seat are to be credited. Where the seat is resold under section 9, section 9.2 applies.

8.6 The decisive point in time for classification is when the cancellation is received by Sky Society.

8.7 The amounts retained include the administrative effort; no separate handling fee is charged in addition. Handling fees already paid under section 9.1 or 10.2 are neither credited nor refunded; they pay for a service already provided. Mandatory rights to cancel free of charge remain unaffected.

8.8 There is no right of withdrawal in the case of contracts for the carriage of passengers.

9 Substitute passengers and resale

9.1 A transfer of the booking to a substitute passenger, where applicable with a different animal, is possible following timely checks and express release. A handling fee of EUR 150 per substitute passenger applies. Where the transfer takes place more than 14 days before the scheduled departure time, the fee does not apply. Additional costs demonstrably charged by the operator for changing passenger details are passed on separately. Independent commercial resale is prohibited.

9.2 Where a cancelled seat is successfully resold, the amount actually paid by the substitute passenger, less the handling fee, is credited against the original customer's refund claim. The total refund does not exceed the original fare. A higher refund claim already existing under section 8 is not reduced by a resale.

9.3 The additional payment is made within 14 calendar days of payment being received in full from the substitute passenger. Mandatory more favourable claims remain unaffected.

10 Rebooking

10.1 Up to 28 days before the departure booked, the customer may apply for a rebooking. This requires free seats on the flight desired and a fresh release for the carriage of the animal. Sky Society confirms the rebooking expressly.

10.2 A handling fee of EUR 350 per booking applies to a rebooking. If the new flight is more expensive, the customer pays the difference. If it is cheaper, the difference is refunded.

10.3 The 28-day period runs from the original departure date. Where less than 28 days remain, a cancellation under section 8 followed by a new booking is required; a later filling of the seat is taken into account under section 9.

11 Check-in and refusal of carriage

11.1 The terminal, meeting point and check-in deadline are communicated for each flight. The customer must appear in good time with all registered fellow travellers and animals and carry the required original documents.

11.2 If the deadline is missed and the operator cannot wait, the flight may take place without the customer. Where the customer is responsible for the delay, the last sentence of section 8.3 applies; expenses saved and any other use made of the seat are to be credited.

11.3 If the operator waits for a late passenger, additional ground time and operating costs may arise. Where the customer is responsible for the delay, the customer bears those costs in the amount evidenced by the operator and reasonable in the circumstances. Contributory fault of third parties or of Sky Society is to be taken into account. There is no entitlement to waiting time; the decision lies with the operator.

11.4 The details given about passengers, baggage and accompanying animals must be complete and accurate, in particular the number, weight and nature of the items of baggage and the species, breed, age, weight and size of the animal. Items whose carriage is prohibited or subject to declaration under the operator's requirements or the applicable rules may not be carried without being declared; this applies in particular to lithium batteries outside the permitted limits and to recalled devices. Where an item of baggage or an animal cannot be carried because details were inaccurate or missing, section 8 applies accordingly.

11.5 Passengers must follow the crew's safety instructions. Serious breaches of safety, aggressive behaviour or intoxication creating a hazard may justify a refusal of carriage. The financial consequences follow from the cause and responsibility; exclusion does not automatically mean the loss of all claims.

11.6 Children and infants travel only following prior arrangement and confirmation. Minors are carried only in the company of an adult.

12 Carriage of animals and conduct in the cabin

12.1 A jet sharing booking covers one passenger and one animal. Dogs and cats are permitted following release, other species on request. A second animal requires express confirmation and is subject to a surcharge.

12.2 Each request is assessed individually against the aircraft type and the operator's requirements. The confirmed animal details and the carriage requirements communicated are binding. A change of animal must be released in advance.

12.3 The customer supervises and looks after the animal during the journey. The customer brings a blanket, a lead and a collar or harness.

12.4 There is no muzzle requirement on board. A muzzle must nevertheless be carried and fitted where security staff at screening, the captain or the competent authorities require it. The decision on securing the animal, in particular during take-off and landing, lies with the crew.

12.5 Dogs must lie on a blanket and may not use seat surfaces unprotected.

12.6 Seats are allocated by the crew. There is no entitlement to a particular seat; the crew may change the seating for safety or operational reasons.

12.7 For attributable damage and any necessary special cleaning, the customer bears the costs evidenced and reasonable in the circumstances. The amount follows from the extent of the damage or soiling. Contribution by others involved is to be taken into account.

13 Animal documents

13.1 The customer is responsible for the completeness, accuracy and timely procurement of all required travel and animal documents and permits. Sky Society does not check these documents, does not monitor deadlines and owes no advice on entry or veterinary requirements.

13.2 The customer may organise the documents personally, engage a provider of their choice, or ask Sky Society to put them in touch with a specialised agency. Engaging that agency is voluntary and is not required for the booking. The contract, scope of services, deadlines and costs are agreed directly between the customer and the agency; Sky Society is not a party to it.

13.3 Agency costs are not part of the fare and are shown separately in the booking process. Sky Society gives no assurance as to the outcome of official procedures and no guarantee of entry.

13.4 Where a customer or an animal cannot travel because documents are missing or incorrect, section 8 applies. The remaining passengers on the same booking may travel.

13.5 Where the confirmed carriage of the animal in the cabin is not met for organisational reasons on the operator's part, the customer is offered a suitable alternative or a full refund of the flight booking concerned that was not provided.

13.6 Where an authority refuses entry without any failure on the customer's part, rebooking options and the unavoidable costs actually remaining are examined first. A rebooking may be offered with credit for the amount still available; additional costs require prior consent. General flight or entry bans fall under section 7.

14 Full charter

14.1 In the case of a full charter, Sky Society sells the carriage of the whole aircraft in its own name. Sections 1 to 3, 5 to 7 and 11 to 18 apply accordingly.

14.2 The number of passengers and animals, the route, date, baggage, catering and further services are set out in the individual offer. Complete passenger and animal details are to be provided by the time stated in the offer.

14.3 The customer pays the agreed total amount to Sky Society. Sections 4.3 and 4.4 do not apply; there is no minimum occupancy.

14.4 Changes to the route, date, passengers or animals require an availability check and express confirmation. Additional costs are confirmed by the customer before being ordered.

14.5 Cancellation by the customer is governed by the scale stated in the individual offer; that scale follows the conditions of the operator used for the flight concerned and is communicated before the contract is concluded. Section 8.5 applies accordingly. The scale under section 8.2 and the rebooking rule under section 10 do not apply automatically to a full charter.

15 Prices and payment

15.1 The invoicing currency follows the recipient of the invoice. Sky Society invoices customers resident in the United Arab Emirates in AED, and customers resident outside the United Arab Emirates in EUR or, on request, in AED. The currency shown for the flight concerned during the booking process applies. Payment is made by bank transfer to the company account stated in the offer. A binding booking requires payment to be received in full.

15.2 No charges are levied for payment.

15.3 Justified and evidenced subsequent additional costs under sections 5.3, 5.8, 10.2, 11.3 or 12.7 are payable within 14 calendar days of being invoiced.

15.4 The amounts stated in these terms are given in EUR. Where invoicing is in AED, the corresponding amount in AED applies; it is shown before booking and is based on the exchange rate applied by Sky Society when the flight was published.

16 Refunds

16.1 Refunds are made to the account from which payment was made, in the original invoicing currency.

16.2 Where Sky Society cancels, the refund is made within 14 calendar days of the cancellation. Where the customer cancels, the amount remaining under section 8 is repaid within 14 calendar days of receipt of the cancellation. Additional refunds arising from a resale are governed by section 9.3. Mandatory shorter statutory periods take precedence.

17 Liability

17.1 Sky Society is liable for the obligations it has assumed in accordance with the applicable statutory provisions. As contracting carrier, Sky Society is liable for damage to persons and baggage and for damage caused by delay under the Montreal Convention alongside the operating carrier.

17.2 The customer's responsibility for travel and animal documents, and the engagement of independent service providers, do not exclude Sky Society's liability for its own breaches of duty.

17.3 Mandatory liability for damage to persons, animals and baggage and statutory air passenger rights remain unaffected. Liability is not limited for intent, gross negligence or breach of material contractual obligations.

18 Data protection and complaints

18.1 Information on the processing of personal data is set out in the privacy policy at skysocietyjet.com/en/info/privacy-policy. Acceptance of these terms does not replace any separate data protection consent that may be required.

18.2 Complaints and reports of damage may be addressed to hello@skysocietyjet.com quoting the booking reference. Statutory notification and limitation periods remain unaffected; these terms introduce no additional cut-off periods.

18.3 Sky Society is neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration body.

19 Contract language and final provisions

19.1 These terms are available in German and English. The language version in which the booking was made prevails.

19.2 The law of the United Arab Emirates applies. This choice of law does not affect mandatory consumer protection provisions of the country in which the customer is habitually resident.

19.3 The place of jurisdiction for all disputes arising from this contract is Dubai, United Arab Emirates. Customers who are consumers may also bring proceedings against Sky Society at their own general place of jurisdiction; mandatory rules on consumer jurisdiction remain unaffected.

19.4 Individual agreements and mandatory law take precedence over these terms. Should any provision be invalid, the remainder of the contract remains in force.
